End User License Agreement

This EULA governs the license to install and use the Block battle application. Online accounts and multiplayer services are also governed by the Terms of Service.

Apple App Store users: unless the App Store product page expressly identifies a custom EULA, Apple's Standard Licensed Application End User License Agreement applies to your license. The terms below supplement that agreement only to the extent they do not conflict with it. For all other distribution channels, the terms below are the applicable EULA.

1. Agreement and licensor

The application is licensed, not sold. Your licensor is the developer identified in the applicable Google Play or Apple App Store listing, operating the product under the Block battle name (“Licensor”, “we”, “us”, or “our”). The store operator is not the licensor of Block battle unless its own terms say otherwise.

By installing or using the application, you accept this EULA and the applicable store usage rules. If you do not accept them, do not install or use the application.

2. Limited license

Subject to this EULA, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of Block battle on compatible devices you own or control, solely for personal, non-commercial entertainment and as permitted by the applicable store's usage rules.

Store-supported family sharing, volume purchasing, and use on multiple devices are permitted only as allowed by the store's rules. No ownership right in the application or service is transferred to you.

3. License restrictions

Except where applicable law expressly permits it, you may not:

  • copy, redistribute, sell, rent, lease, sublicense, publish, or commercially exploit the application;
  • reverse engineer, decompile, disassemble, derive source code from, modify, or create derivative works of the application;
  • remove copyright, trademark, attribution, or technical-protection notices;
  • bypass access controls, interfere with service operation, use cheats or automation, or connect an unauthorized client;
  • use the application in violation of law, store rules, the Terms of Service, or another person's rights.

4. Updates and online services

We may provide updates, patches, balance changes, or new versions. An update may be required for security or continued access to online features. Unless accompanied by a different license, this EULA applies to updates that replace or supplement the application.

Multiplayer, leaderboards, authentication, notifications, and other connected functions are online services, not part of a perpetual software entitlement. They may change or become unavailable as described in the Terms of Service.

5. Data and privacy

The Privacy Policy describes how Block battle handles data. The application may store local settings and account information on your device and transmit account, gameplay, profile, security, and notification data as needed to provide online features.

6. Third-party software and services

Block battle may use open-source components and services supplied by a store, Firebase, an authentication provider, or another vendor. Separate terms may apply to those components and services. Third-party websites opened from player profile links are outside our control and are used at your own discretion.

You must comply with applicable third-party terms when using their services. To the maximum extent permitted by law, we are not responsible for the availability, accuracy, security, or content of independently operated external services.

7. Ownership and intellectual property

Block battle and its software, artwork, audiovisual elements, branding, and related materials are owned by or licensed to us and protected by intellectual-property laws. We reserve all rights not expressly granted in this EULA. Player Content is addressed in the Terms of Service.

8. Term and termination

This EULA continues until terminated. You may terminate it by uninstalling the application and ceasing use. Deleting an online account is a separate action.

Your license terminates automatically if you materially violate this EULA. On termination, stop using and delete all copies of the application. Sections that by their nature should survive will remain effective.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION AND ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. WE DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, COMPATIBLE WITH EVERY DEVICE, OR FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU. MANDATORY CONSUMER RIGHTS REMAIN UNAFFECTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM THE APPLICATION OR SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APPLICATION IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50.

These limits do not apply to fraud, intentional misconduct, personal injury caused by negligence where liability cannot be limited, or any other liability that applicable law does not allow us to exclude.

11. Legal and export compliance

You may not use, export, or re-export Block battle except as authorized by the laws of the jurisdiction in which you obtained it and applicable export-control and sanctions laws. You represent that you are not prohibited from receiving the application under applicable trade restrictions and will not use it for a prohibited purpose.

12. Additional terms for Apple App Store users

For an application obtained through Apple's App Store:

  • This EULA is between you and us, not Apple. We, not Apple, are responsible for Block battle and its content.
  • Your license is limited to use on Apple-branded products you own or control as permitted by Apple's Usage Rules, including any permitted Family Sharing or volume-purchase access.
  • Apple has no obligation to provide maintenance or support for Block battle.
  • To the extent any warranty exists and Block battle fails to conform to it, you may notify Apple and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • We, not Apple, are responsible for addressing claims relating to Block battle, including product-liability, legal-compliance, and consumer-protection claims.
  • We, not Apple, are responsible for investigating and resolving a claim that Block battle infringes a third party's intellectual-property rights.
  • Apple and its subsidiaries are third-party beneficiaries of these Apple-specific terms and may enforce them after your acceptance.

If Apple's Standard EULA applies, it controls wherever these supplemental terms are inconsistent with it.

13. General

If a provision is unenforceable, it will be narrowed only as much as needed and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign this EULA without our consent; we may assign it as part of a business reorganization, subject to applicable law.

The governing-law and dispute provisions in the Terms of Service apply to this EULA without displacing mandatory rights in your country of residence.
